Fail: Florida Medical Marijuana Bill Bans Smoking, Discourages Doctors From Participating

Senate Bill 303 passed the Senate Finance Committee on a 3-2 party-line, the same vote that killed House Bill 1242, the bipartisan bill co-sponsored by Senate President Kevin Grantham and House Speaker Crisanta Duran.

"The bill also says that patients with chronic pain can access the drug, but only if that pain is directly linked to a debilitating condition that would have qualified them regardless", the Herald/Times reports.

Perhaps another year or more of study will give the state a marijuana legalization law that improves on the experience as seen in Colorado, Washington state and now MA.

"We're trying to find out what it is this entire elected body wants to do", said House Speaker Ron Ryckman, an Olathe Republican struggling to accommodate clashing interests. The bill was actually more restrictive than the laws in place before Floridians legalized medical cannabis.

But those guidelines are far from the only boneheaded measures crippling the bill. The House also backed away from requiring doctors to recertify patients every three months. A scrum around Beyor after the vote congratulated him for having the courage some said they lacked to go against the bill.

Factional and partisan demands on tax, budget and education funding complicated House and Senate negotiations executed with an eye to what Gov. Sam Brownback might sign into law.

"It's a willful ignorance", he says. "The incentive that the rule creates.is to hide ownership and investment in the state's new marijuana business and it further stands to discourage investment from qualified participants from beyond our borders".

We reached this conclusion not because we think that marijuana is harmless, or because we like the idea of people walking around stoned, but because legalization would create some consistency with state policy on substances we know are harmful when used carelessly, but create tax revenue for the state: Alcohol and tobacco.

And it's clear that license holders are already able to make vast sums of money from exploiting the cartel system.

"If you receive these benefits from your employer, you're one of the privileged few", Stevens said.

Emergency versions of rules from the Arkansas Medical Marijuana Commission, Alcoholic Beverage Control and the Board of Health were approved without debate by a subcommittee of the Arkansas Legislative Council. A Committee of Conference, consisting of three senators and three representatives, will hash out these differences and bring forth their plan for a balanced budget on the last day of the session. His view reflected a prevailing belief in the Capitol that passing tax legislation in the Senate will be more challenging than in the House.

Pollara urged the Senate to "adopt this amendment and send this legislation back to the House as soon as possible".

The challenge we all face to address the affordable housing crisis lies not only in adding new affordable homes.

But, he warned, "the state legislature has a rich history of thwarting the will of the people".
